Terms of Service
1. Acceptance
1.1 Parties: These Terms are between Nurtur Wellness Pty Ltd ABN 98 696 241 835 trading as Nurtur Tea, its successors and assignees ("we", "us", "Nurtur Tea") and you, the person, organisation or entity buying Products, booking an Event or placing a Wholesale Order ("you", "the Customer"). These Terms apply to all Products, Events and services we supply to you.
1.2 How you accept: You accept these Terms when you:
- (a) place an order through nurturtea.com or any of our sales channels;
- (b) purchase a ticket or booking for an Event;
- (c) confirm a Wholesale Order in writing, including by email or text message;
- (d) make part or full payment for any Products or Events; or
- (e) accept delivery of any Products.
1.3 Electronic acceptance (including ticking a checkbox at checkout) is binding, consistent with the Electronic Transactions (Queensland) Act 2001.
1.4 By purchasing from us you confirm you have had the opportunity to read these Terms, contact us with any questions, and that you accept and will comply with them.
1.5 If these Terms are inconsistent with any other document between us, these Terms prevail, unless clause 13.9 (Special Conditions) applies.
1.6 We may update these Terms from time to time. The version published on nurturtea.com at the time of your order or booking applies to that order or booking.
1.7 Any information or general guidance we give about our Products is provided in good faith based on our knowledge and experience. It is your responsibility to decide whether a Product is suitable for you (see clause 8).
2. Products, Orders and Pricing
2.1 We sell herbal teas, matcha, tea accessories, gift boxes and self-care items ("Products") through nurturtea.com, markets, events and wholesale channels.
2.2 All orders are subject to acceptance and availability. We may refuse or cancel any order we consider unreasonable, fraudulent, or outside our ability to fulfil. If we cancel an order after payment, we will refund you in full.
2.3 If a Product becomes unavailable after you order, we will contact you to offer a substitute of the same or greater value, store credit, or a refund for that item.
2.4 All prices are in Australian dollars and include GST where applicable, unless stated otherwise. Shipping costs are shown at checkout.
2.5 Prices, promotions and discount codes may change without notice. Sale prices apply only while stocks last and for the period advertised. Discount codes cannot be combined unless stated, and cannot be applied after an order is placed.
2.6 We take care to display Products accurately. Because our blends are made from natural botanicals, colour, aroma, leaf size and taste may vary slightly between batches and from photos. This is not a fault.
2.7 If a price is displayed incorrectly due to an obvious error, we may cancel the order and refund you in full.
3. Payment
3.1 Retail orders and Event bookings must be paid in full at the time of purchase, using the payment methods offered at checkout (including card and Afterpay where available).
3.2 Orders are not processed or dispatched, and Event places are not confirmed, until payment is received and cleared.
3.3 Wholesale invoices must be paid by the due date shown on the invoice. If payment is late, we may pause further orders and deliveries until the account is paid.
3.4 We may charge interest on overdue wholesale amounts at the Reserve Bank of Australia cash rate plus 8% per annum, calculated daily.
3.5 If amounts remain unpaid, we may engage debt collection services or commence legal proceedings. You agree to pay our reasonable costs of recovery, including debt collection and legal costs.
3.6 You may not deduct or withhold any amount from an invoice because part of it is in dispute. Please raise the issue with us under clause 12 and pay the undisputed amount.
4. Shipping, Delivery and Risk
4.1 We ship within Australia only, from our warehouse at 10/16 Natasha Street, Capalaba, Queensland. We do not currently ship internationally. Free standard shipping applies to orders over the threshold shown on our website at the time of purchase.
4.2 We dispatch on business days only, not on weekends or public holidays. Estimated delivery times after dispatch are 2 to 3 business days for QLD, NSW, ACT and VIC, 3 to 5 business days for NT, SA and TAS, and 4 to 7 business days for WA. These are estimates only. If there is an unexpected delay on our end, we will let you know by email. Once your order is handed to the carrier, delivery times are outside our control and we are not liable for carrier delays.
4.3 You must provide a complete and correct delivery address. We are not responsible for orders delayed or lost due to an incorrect address. Re-delivery costs for returned parcels are payable by you.
4.4 Risk in the Products passes to you on delivery, including where a parcel is left at your address in line with the carrier's authority-to-leave process.
4.5 If your parcel arrives damaged or is lost in transit, contact us within 7 days of delivery (or of the expected delivery date) with your order number and photos of any damage, and we will work with you and the carrier to resolve it.
4.6 Local pick-up from our warehouse may be offered by arrangement. Pick-up orders not collected within 30 days may be cancelled and refunded, less any reasonable handling costs.
5. Returns and Refunds
5.1 Change of mind: You may return unopened Products in their original sealed packaging within 30 days of receiving them, for a refund, store credit or a different product. Return postage is at your expense. For hygiene and food safety reasons, we cannot accept opened Products for change of mind, including where you do not like the taste.
5.2 This does not affect your rights under the Australian Consumer Law. If a Product is faulty, damaged, not as described, or not fit for purpose, you are entitled to a replacement or refund, and for a major failure you may choose which.
5.3 How to return: Email hello@nurturtea.com before sending anything back, with your order number, the reason for return, and photos if the Product is faulty or damaged. Items sent back without an approved return request may not be accepted. Approved returns go to 10/16 Natasha Street, Capalaba QLD 4157. For faulty or damaged Products we will cover reasonable return costs.
5.4 Refunds: We will let you know once we have received and inspected your return. Approved refunds, replacements or store credit are processed within 7 days, to the original payment method. Afterpay refunds are processed through Afterpay. Your bank may take a few extra days to show the refund.
5.5 Sale items and gift cards are not eligible for change-of-mind returns. This does not affect your rights under clause 5.2.
5.6 Gift cards and store credit are not redeemable for cash, except where required by law.
5.7 Pre-orders and subscriptions: Where we offer a pre-order, you may cancel it at any time before it is fulfilled. Where we offer a subscription, you can change or cancel it at any time before your next billing date, using the link in your order confirmation email.
6. Events
6.1 Scope: This clause applies to any workshop, tea or matcha experience, brand event, collaboration, class or gathering hosted or co-hosted by Nurtur Tea ("Event"), whether held at our warehouse or another venue.
6.2 Bookings: Your place is confirmed only once full payment is received. Places are limited and allocated in order of payment. Event tickets are non-transferable to another Event, but you may transfer your ticket to another person by emailing us with their name at least 48 hours before the Event.
6.3 Cancellation by you: As ingredients and supplies are purchased in advance specifically for your Event, payments are non-refundable if you cancel, postpone or change the date of your booking, including changes due to weather. Where possible, Nurtur Tea will work with you to accommodate a rescheduled date, subject to availability and the suitability of ingredients and supplies already purchased.
6.4 Cancellation by us: If we need to cancel or postpone an Event due to circumstances outside our control, such as illness, severe weather or venue issues, we will first offer you a rescheduled date, subject to availability. If a suitable new date cannot be agreed, we will refund your payment.
6.5 Changes to an Event: We may change the date, time, venue, presenters or program of an Event. If we make a significant change, we will notify you as soon as practicable by the email or phone number used to book.
6.6 Venue access: Events held at the Nurtur Tea warehouse in the Redlands are accessed by stairs, and the venue is not wheelchair accessible. Please contact us before booking if you have access needs so we can discuss options.
6.7 Allergies and dietary needs: Our Events may involve tasting teas, matcha, herbs, spices and food. You must tell us about any allergies, intolerances, pregnancy, breastfeeding or health conditions before the Event. You are responsible for deciding what you consume.
6.8 Conduct: We may refuse entry to, or ask to leave, anyone whose behaviour is unsafe, disruptive or inappropriate, without a refund.
6.9 Alcohol: Where an Event or partner collaboration includes alcohol, attendees must be 18 years or over, and alcohol will be served responsibly in line with Queensland liquor laws.
6.10 Photography: We may take photos and videos at Events for use on our website, social media and promotional material. Please let us know at the Event if you do not wish to be photographed.
6.11 Personal belongings: You are responsible for your own belongings at Events. To the extent permitted by law, we are not liable for loss or damage to personal items.
7. Wholesale
7.1 This clause applies to businesses buying Products for resale or use in their business ("Wholesale Customers"), whether ordered directly, through our wholesale portal, or through a third-party marketplace. Orders placed through a marketplace such as Faire are also subject to that marketplace's terms.
7.2 Wholesale pricing, minimum order quantities and payment terms are as set out in our wholesale price list or quote at the time of order.
7.3 Retention of title: Ownership of Products does not pass to you until we have received payment in full. Until then, you hold the Products as bailee for us, may sell them only in the ordinary course of business, and we may recover unsold Products if payment is not made.
7.4 PPSA: These Terms create a security interest in Products supplied to Wholesale Customers for the purposes of the Personal Property Securities Act 2009 (Cth). You agree to sign any documents we reasonably need to register that interest, and waive your right to receive notices under sections 95, 118, 121(4), 130, 132(3)(d) and 132(4), and a verification statement under section 157, of that Act.
7.5 Brand use: You must present Nurtur Tea Products in their original packaging and must not make any health or therapeutic claims about them beyond the wording on our packaging and website. You may use our images and product copy only to promote our Products.
7.6 Storage: You must store Products in a cool, dry place away from direct sunlight and strong odours, and rotate stock by best-before date. We are not responsible for deterioration caused by your storage.
7.7 Wholesale Products are supplied for business purposes. To the extent permitted by law, change-of-mind returns are not accepted. Claims for damaged or incorrect stock must be made within 7 days of delivery.
8. Product Information and Health Disclaimer
8.1 Our herbal blends are formulated with naturopathic input and draw on traditional herbal use. Product information on our website, packaging, social media and at Events is general information only. It is not medical advice and is not intended to diagnose, treat, cure or prevent any condition.
8.2 If you are pregnant, breastfeeding, taking medication, have a medical condition, or are buying for a child, please check with your doctor or qualified health practitioner before using our Products.
8.3 Ingredients are listed on each product page and package. Our Products are packed in a facility that may handle other herbs, spices and botanicals. You are responsible for checking ingredients for any allergy or intolerance before use.
8.4 Follow the brewing and storage directions provided. Consume Products before the best-before date shown on the packaging.
8.5 Our matcha and Daintree black tea contain naturally occurring caffeine. It may not be suitable for people sensitive to caffeine.

9. Consumer Law, Liability and Indemnity
9.1 Australian Consumer Law: Our Products and Events come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) in the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts or modifies those rights.
9.2 Warranties: Except for your rights under the ACL, we exclude all other express and implied warranties. For accessories we do not manufacture, the manufacturer's warranty applies.
9.3 Exclusions: To the extent permitted by law, we are not liable for:
- (a) reactions, sensitivities or allergies where ingredients were disclosed;
- (b) Products that have been stored or prepared other than as directed;
- (c) delays or failures caused by carriers, suppliers or events outside our reasonable control;
- (d) minor natural variations in colour, aroma, taste or appearance; or
- (e) any indirect or consequential loss, including loss of profit, revenue or opportunity.
9.4 Limitation: To the extent permitted by law, our total liability for any claim is limited, at our option, to replacing the Products or Event place, or refunding the amount you paid for the Products or Event to which the claim relates.
9.5 Indemnity: You indemnify us against any claims, costs and losses (including reasonable legal costs) arising from inaccurate information you give us, your breach of these Terms, your misuse of the Products, or, for Wholesale Customers, any claims you make about the Products that we have not approved.
9.6 Force majeure: We are not liable for any delay or failure to perform our obligations caused by circumstances beyond our reasonable control, including illness, natural disasters, severe weather, pandemics, supplier or carrier failure, or government directions.
9.7 This clause survives the end of any order or booking.
